You will need to take this up with the Administrator. The Administrator has to
do a report on the Directors of the business. This evidence forms part of the
Creditor Questionnaire which hopefully you have received. It is therefore an
onous of all the creditors to provide as much factual evidence as they can.
Any information that can be provided to prove trading whilst knowingly
insolvent,
mirepresentation, or fraud may lead to the Department of Trade and Industry
taking legal action against the Director(s) personally. Any Director convicted
of wrongful acts could lead to he or she being prevented from being a Director
of a company in the future and in serious cases criminal procedures may
be taken which could lead to imprisonment. In these situations where the
general
public are involved the DTI are likely to be particularly aggressive.
Unfortunately non of this will necessarily help in getting your money back.
